Premarital Property – “I Had It Before I Married You So It Is Mine!”… Maybe Not…

A common misconception for most people going through a divorce is that if they owned a piece of property, or an asset, before they married their partner that it is theirs. That may, or may not, be the case. The Iowa law states that premarital property “may” be given back to the person who owned it prior to the marriage. The word “may” gives the courts the ability to determine if it will give the property back the party who owned it before the marriage. There are several things the courts will consider in making this determination and it is imperative that you speak with a family law attorney to help you determine if these considerations apply to your property or not. Some of those factors may include commingling premarital property with marital property, or if one spouse contributes marital funds to the premarital property.
